Thomas, <a href=\"https:\/\/www.swimmingworldmagazine.com\/news\/lia-thomas-transgender-swimmer-from-penn-swims-fastest-times-in-nation-controversy-brewing\/\" target=\"_blank\" rel=\"noopener\">a transgender female who owns the top times in the country in the 200 and 500 freestyle<\/a>, has been eligible under the existing NCAA rules, but the latest announcement called her ability to remain eligible into question.<\/p>\n<p>Champion Women, an organization led by Olympic gold medalist <a href=\"https:\/\/www.swimmingworldmagazine.com\/news\/olympic-champion-womens-sports-advocate-nancy-hogshead-makar-explains-problems-with-lia-thomas-situation\/\"><strong>Nancy Hogshead-Makar <\/strong><\/a>which advocates for girls and women in sports, has launched a petition aimed at USA Swimming, encouraging the national governing body &#8220;to adopt transgender eligibility guidelines that are evidence-based and that affirm fairness in the women\u2019s swimming category.&#8221; The petition adds that notes the urgency of the request, with the NCAA Championships less than two months away. It says, &#8220;we respectfully request that USA Swimming adopt an interim evidence-based transgender eligibility process\u00a0to be announced well before the Women\u2019s NCAA Championships, March 16-19, 2022, in Atlanta, Georgia.&#8221;<\/p>\n<p>The petition lays out its requests for new transgender participation policy that would guide the sport, and it argues that current rules from the NCAA, USA Swimming and FINA &#8220;prioritize the interests of transgender individuals over the interests of biological females.&#8221; It then states that women&#8217;s sports &#8220;are separate from men\u2019s because of the immutable physical and physiological differences between males as a group and females as a group,&#8221; which the petition argues cannot be nullified by hormone therapy.<\/p>\n<p>The petition claims that sports organizations should stand up for competitive equity for women and compares the failure to do so as comparable with the East German doping scandal of the 1980s. The petition uses data from Thomas for an example, showing how she has been more successful as a female swimmer than when she was competing in the men&#8217;s category. It also emphasizes that transgender athletes would be provided with inclusive opportunities in the sport.<\/p>\n<p>\u201cSwimming teams are typically co-ed,&#8221; noted Hogshead-Makar. &#8220;More often than not, we train, lift, stretch, travel, and compete together. Separating just girls&#8217; and women&#8217;s competition eligibility from team inclusion means that transgender athletes will always be able to participate in the social construct of sport &#8211; the 95% of sport &#8211; the workouts, socializing, team meetings, and travel. Therefore,\u00a0<strong>we respectfully request that USA Swimming adopt an interim evidence-based transgender eligibility process<\/strong>\u00a0<strong>to\u00a0be announced well before the Women\u2019s NCAA Championships, March 16-19, 2022, in Atlanta, Georgia.<\/strong><\/p>\n<p>Respectfully, we request that USA Swimming\u2019s interim eligibility process incorporate the following elements:<\/p>\n<ol>\n<li style=\"list-style-type: none;\">\n<ol>\n<li>An expert review committee consisting of recognized experts in swimming performance, sex differences in human performance, physiology, cardiology, and endocrinology.<\/li>\n<li>Examination of physician documented evidence such as:\n<ol>\n<li>Suppression of testosterone into the female range for a minimum number of years prior to swimming competition in the female category.<\/li>\n<li>Demonstration of continuation of suppression of testosterone in the female range during the period of eligibility for swimming regular season and championship competition in the female category.<\/li>\n<li>Necessary certifications concerning timing, levels, and consistency, should be reported by the athlete\u2019s treating endocrinologist to ensure monitoring is not unnecessarily intrusive.<\/li>\n<\/ol>\n<\/li>\n<li>Consideration of male-puberty mitigation in swimming performance by event, such as:\n<ol>\n<li>Examination of pre-\/post- transition time declines compared to the current NCAA qualifying time male\/female percent difference as a proxy for the expected male\/female difference.<\/li>\n<li>Examination of pre-\/post- hierarchical ranking in male and female D-I swimmers to<br \/>\ndetermine whether these\u00a0rankings are reasonably within the same range.<\/li>\n<li>Examination of pre-\/post- video evidence of swimming performance to verify that the swimmer is maximizing their performance effort.<\/li>\n<\/ol>\n<\/li>\n<li>Review of drug testing results during the regular season or at conference or NCAA<br \/>\nchampionship events.<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<p>Sports organizations regularly recite that they will \u201cbalance inclusion, safety and fairness.\u201d But their inadequate transgender eligibility standards are failing biological females, 54.2% of USA Swimming\u2019s member-athletes in 2020. While we do not know how many transgender athletes are participating in competitive men\u2019s and women\u2019s sport programs, we do know that inadequate eligibility standards (as currently exist in the NCAA, USA Swimming and FINA) prioritize the interests of transgender individuals over the interests of biological females.<\/p>\n<p>In the 1970s and 1980s, sport failed to address the travesty of East German women dominating swimming by ingesting and injecting large amounts of performance enhancing drugs. At the time, sport leaders did not stand up for U.S. women who were not testosterone advantaged. Instead, women were told to be gracious losers. Now in 2022, on the 50th anniversary of Title IX, USA Swimming\u2019s 2022 guidelines on transgender inclusion must support competitive equality for biological women. Do not tell women to be gracious losers again.<\/p>\n<p>Women\u2019s sports, including women\u2019s swimming, are separate from men\u2019s because of the immutable physical and physiological differences between males as a group and females as a group. As a legal matter, there is no alternative, defensible, rationale for sex-segregation in sport. Recognizing, respecting, and accommodating male and female differences ensures that sport meets its social justice obligations to both female and transgender athletes, enables fair and safe competitive sport, and secures the integrity and viability of female sport.<\/p>\n<hr \/>\n<p><u>The Immediate Issue:<\/u><u><\/u><u><\/u><\/p>\n<p>In 2021, a transgender woman began competing for the University of Pennsylvania in the Women\u2019s NCAA Division 1 category after three years competing on the men&#8217;s team, Lia Thomas. Lia is on track to win at the Women\u2019s NCAA Championships, and possibly even break Missy Franklin and Katie Ledecky\u2019s records. The male-female performance gap in NCAA swimming is between 8.7% in distance events and 13.3% in the sprints. But Lia\u2019s testosterone suppression has not resulted in moving her times anywhere close to the times necessary to demonstrate she has \u201cmitigated\u201d the advantage she received from 10 years of male-puberty. Based on NCAA historical performance data and the effects of testosterone suppression, Lia\u2019s fast times are unlikely to be the result of normal development over time, including male-typical training gains in the collegiate cycle.<\/p>\n<p><img decoding=\"async\" class=\"aligncenter\" src=\"https:\/\/ci4.googleusercontent.com\/proxy\/CirXl1HWlajCGGtQ5RXZoDTEaVVYCeYEfnIkGN_JveGvEgc1M2OsCBii7QB2RvUxaZ3FZWYLSpj17q2BBPTx5oNZcWcq6-xiuuoC0VeO0dfgcxrBV7sL6qW3=s0-d-e1-ft#https:\/\/nfg-dm-bee.s3.amazonaws.com\/images\/championwomen\/lt%20chart.png\" \/><\/p>\n<blockquote>\n<div dir=\"ltr\">\n<p>Had testosterone suppression worked to roll back Lia\u2019s male-puberty advantages, we would have expected to see the gap between her performances grow at least to approximate the gap between males and females generally. Instead, Lia has gone from being ranked #462 in the country in the men\u2019s 200 yard freestyle, to #1 in the women\u2019s 200 yard freestyle.
