﻿{"id":479328,"date":"2021-06-21T21:57:47","date_gmt":"2021-06-22T04:57:47","guid":{"rendered":"https:\/\/www.swimmingworldmagazine.com\/news\/?p=479328"},"modified":"2021-06-21T21:57:47","modified_gmt":"2021-06-22T04:57:47","slug":"supreme-court-unanimously-rules-against-ncaa-in-compensation-case","status":"publish","type":"post","link":"https:\/\/www.swimmingworldmagazine.com\/news\/supreme-court-unanimously-rules-against-ncaa-in-compensation-case\/","title":{"rendered":"Supreme Court Unanimously Rules Against NCAA in Compensation Case"},"content":{"rendered":"<p><strong>Supreme Court Unanimously Rules Against NCAA in Compensation Case<\/strong><\/p>\n<p>The Supreme Court Monday ruled by a 9-0 margin to affirm a decision that allows a pathway for NCAA student-athletes to be compensated by schools.<\/p>\n<p>The decision upheld a district court ruling that the NCAA violated antitrust law in limiting the education-related benefits that athletes can receive from schools. It removes the caps on education-related compensation that schools can provide. The case, NCAA vs. Alston et al, applies further pressure on the NCAA, in addition to the growing calls for athletes to profit off their name, image and likeness (NIL) via third-party endorsements that have <a href=\"https:\/\/www.swimmingworldmagazine.com\/news\/new-florida-law-to-allow-college-athletes-to-profit-from-name-image-and-likeness\/\" target=\"_blank\" rel=\"noopener noreferrer\">prompted legislation in 19 states<\/a>.<\/p>\n<p><a href=\"https:\/\/www.supremecourt.gov\/opinions\/20pdf\/20-512_gfbh.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Read the full court opinion here<\/a>.<\/p>\n<p>Writing for the majority, Justice <strong>Neil Gorsuch<\/strong> penned a narrow opinion asserting that the 9th Circuit Court ruling in 2018 was correct by holding that, \u201cthe student-athletes had shown the NCAA enjoys the power to set wages in the market for student-athletes\u2019 labor\u2014and that the NCAA has exercised that power in ways that have produced significant anticompetitive effects.\u201d However, Gorsuch does not prescribe solutions, urging judicial caution in stepping in to fix private business relationships. While the decision does serve <a href=\"https:\/\/www.sportico.com\/law\/analysis\/2021\/supreme-court-rules-unanimously-against-ncaa-in-alston-case-1234632182\/\" target=\"_blank\" rel=\"noopener noreferrer\">to further chip away<\/a> at the NCAA\u2019s view of amateurism, it does not explicitly declare it as violating anti-trust laws.<\/p>\n<p>The specific issue is over academic-adjacent expenses, such as computer costs, study abroad and internships, can be handled. The NCAA rules on those now must be modified or replaced, which gives individual schools more discretion on how to allocate those resources. The larger picture sets Alston as precedent for future litigation against the NCAA and its anti-trust standing.<\/p>\n<p>The more forceful rebuke of the NCAA was provided in Justice <strong>Brett Kavanaugh\u2019s<\/strong> concurring opinion. It begins by explicitly stating that \u201cthe NCAA has violated the antitrust laws\u201d dating to the Sherman Act of 1890, passed little more than a decade before the NCAA was formed. While reasserting that Monday\u2019s decision is narrow in the portion of the NCAA\u2019s business it is ruling on, Kavanaugh highlights that \u201cthe NCAA\u2019s remaining compensation rules also raise serious questions under the antitrust laws.\u201d<\/p>\n<p>Among the three points Kavanaugh makes:<\/p>\n<ul>\n<li>The Supreme Court is not now addressing the legality of said rules.<\/li>\n<li>The Court\u2019s decision does, however, \u201cestablish how any such rules should be analyzed going forward\u201d (i.e. via \u201cordinary rule of reason scrutiny,\u201d as Gorsuch writes was applied in the Alston case)<\/li>\n<li>There are \u201cserious questions\u201d about whether the NCAA\u2019s rules can survive such scrutiny, Kavanaugh calling the NCAA\u2019s larger argument that its policies are pro-competitive \u201ccircular and unpersuasive\u201d<\/li>\n<\/ul>\n<p>From Kavanaugh\u2019s opinion:<\/p>\n<blockquote><p><em>&#8220;The NCAA\u2019s business model would be flatly illegal in almost any other industry in America. All of the restaurants in a region cannot come together to cut cooks\u2019 wages on the theory that \u201ccustomers prefer\u201d to eat food from low-paid cooks. Law firms cannot conspire to cabin lawyers\u2019 salaries in the name of providing legal services out of a \u201clove of the law.\u201d Hospitals cannot agree to cap nurses\u2019 income in order to create a \u201cpurer\u201d form of helping the sick. News organizations cannot join forces to curtail pay to reporters to preserve a \u201ctradition\u201d of public-minded journalism. Movie studios cannot collude to slash benefits to camera crews to kindle a \u201cspirit of amateurism\u201d in Hollywood. \u2026<\/em><\/p>\n<p><em>\u201cThe bottom line is that the NCAA and its member colleges are suppressing the pay of student athletes who collectively generate billions of dollars in revenues for colleges every year.\u201d<\/em><\/p><\/blockquote>\n<p>The NCAA <a href=\"https:\/\/www.ncaa.org\/about\/resources\/media-center\/news\/ncaa-statement-us-supreme-court-decision\" target=\"_blank\" rel=\"noopener noreferrer\">released a brief statement<\/a> hewing to procedural grounds in which Gorsuch reaffirms the NCAA\u2019s authority on certain matters. The statement <a href=\"https:\/\/www.swimmingworldmagazine.com\/news\/new-federal-bill-being-pushed-for-name-image-likeness-endorsements\/\" target=\"_blank\" rel=\"noopener noreferrer\">also introduces the NIL legislation<\/a>, which Gorsuch only makes passing reference to.<\/p>\n<p>\u201cEven though the decision does not directly address name, image and likeness, the NCAA remains committed to supporting NIL benefits for student-athletes,\u201d NCAA President <strong>Mark Emmert<\/strong> said in the statement. \u201cAdditionally, we remain committed to working with Congress to chart a path forward, which is a point the Supreme Court expressly stated in its ruling.\u201d<\/p>\n<p>That statement appears to be looking at the next battle already. Certainly, Kavanaugh\u2019s opinion is, as well. He concludes:<\/p>\n<blockquote><p><em>\u201cTraditions alone cannot justify the NCAA\u2019s decision to build a massive money-raising enterprise on the backs of student athletes who are not fairly compensated. Nowhere else in America can businesses get away with agreeing not to pay their workers a fair market rate on the theory that their product is defined by not paying their workers a fair market rate. And under ordinary principles of antitrust law, it is not evident why college sports should be any different. The NCAA is not above the law.\u201d<\/em><\/p><\/blockquote>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court Unanimously Rules Against NCAA in Compensation Case The Supreme Court Monday
