{"id":441916,"date":"2020-07-28T11:28:08","date_gmt":"2020-07-28T18:28:08","guid":{"rendered":"https:\/\/www.swimmingworldmagazine.com\/news\/?p=441916"},"modified":"2020-07-28T11:28:08","modified_gmt":"2020-07-28T18:28:08","slug":"swiss-federal-tribunal-still-to-rule-on-sun-yang-appeal-against-eight-year-ban-for-manipulation","status":"publish","type":"post","link":"https:\/\/www.swimmingworldmagazine.com\/news\/swiss-federal-tribunal-still-to-rule-on-sun-yang-appeal-against-eight-year-ban-for-manipulation\/","title":{"rendered":"Swiss Federal Tribunal Still To Rule On Sun Yang Appeal Against Eight-Year Ban For Manipulation"},"content":{"rendered":"<p>The<strong> Swiss Federal Tribunal (SFT)<\/strong>, the last court of appeal for Sun Yang after the Chinese swimmer received <a href=\"https:\/\/www.swimmingworldmagazine.com\/news\/sun-yang-cas-report-in-full-athlete-actions-wholly-inappropriate-idtm-testing-exonerated\/\" target=\"_blank\" rel=\"noopener noreferrer\">an eight-year ban from the World Anti-Doping Agency<\/a> for &#8216;manipulation&#8217; of an anti-doping test sample, has confirmed that there is no decision in the case as yet.<\/p>\n<p>Sun&#8217;s initial appeal, made in April, was not the first in a long process that ended up in a hearing before three judges at the<a href=\"https:\/\/www.tas-cas.org\/en\/index.html\" target=\"_blank\" rel=\"noopener noreferrer\"> <strong>Court of Arbitration for Sport<\/strong>\u00a0(CAS)<\/a> last November aheads of a ruling in favour of WADA in February. Last month, Sun&#8217;s lawyers lodged a second appeal that aims to have the eight-year ban reduced.<\/p>\n<p>The SFT Cases 4A_192\/2020 and 4A_318\/2020 \u00a0remain open, the court confirmed to inquiries from the Chinese media.<\/p>\n<p>Sun&#8217;s Swiss law firm, Bonnard Lawson, had already confirmed that Sun had lodged an appeal on April 28. Now, th<em>e <a href=\"https:\/\/www.scmp.com\/sport\/china\/article\/3094746\/sun-yang-no-decision-cas-ban-appeals-yet-says-swiss-federal-tribunal?utm_source=Twitter&amp;utm_medium=share_widget&amp;utm_campaign=3094746\" target=\"_blank\" rel=\"noopener noreferrer\">South China Morning Post<\/a> <\/em>reports the law firm stating:<\/p>\n<blockquote><p>\u201cOn 15 June 2020, Mr. Sun Yang filed an application for revision of the same award in addition to the setting-aside application.\u201d<\/p><\/blockquote>\n<p>The second appeal means that the eight year ban could be reduced rather than dismissed entirely. &#8220;However, the SFT will only rule in Sun\u2019s favour if they find procedural failings with the CAS trial last November,&#8221; reporter\u00a0Jonathan White at the SCMP notes before quoting the rest of the law form&#8217;s statement:<\/p>\n<blockquote><p>\u201cPlease note that during the proceedings, Mr. Sun Yang and the below counsel will not give any interviews or provide further information on the proceedings.\u00a0Mr. Sun Yang will continue to firmly defend his legitimate rights and prove his innocence. He would like to express his gratitude to swimming fans and the public for their consistent support.\u201d<\/p><\/blockquote>\n<p>The SMCP notes that the statement is signed by Fabrice Robert-Tissot of Bonnard Lawson along with Christopher Boog and Philippe Bartsch of Schellenberg Wittmer, another Swiss law firm.\u00a0Schellenberg Wittmer were hired by RUSADA, the Russian Anti-doping Agency, in their own fight against penalties.
