Players in the NBA, WNBA, MLS, MLB, plus tennis player Naomi Osaka and other athletes <a href=\"https:\/\/fortune.com\/2020\/08\/27\/wnba-players-and-naomi-osaka-go-on-strike-for-jacob-blake\/\">refused to take the field this week<\/a>. The athletes&#8217; strike furthers a conversation that was accelerated by the killing of George Floyd, an unarmed black man, by Minneapolis police in late May. After the killing of Floyd, Swimming World spoke to <strong>Anthony Ervin,<\/strong> the first African-American swimmer to win an Olympic gold medal, for his thoughts on athlete protests back in June. \u00a0 <\/em><\/p>\n<p><strong>Anthony Ervin<\/strong> has visited the top step of the Olympic podium often enough to understand how sacred a place it can be. The gold medalist in the men\u2019s 50 free in 2000 and <a href=\"https:\/\/www.youtube.com\/watch?v=6PAXVy0WViE\" target=\"_blank\" rel=\"noopener noreferrer\">2016<\/a>, two very different versions of the cerebral Ervin rose to that hallowed place. If he gets the chance to mount the top step again at the 2021 Olympics, he can\u2019t say a year out what will be <a href=\"https:\/\/www.swimmingworldmagazine.com\/news\/video-interview-catching-up-with-anthony-ervin-on-athlete-issues\/\" target=\"_blank\" rel=\"noopener noreferrer\">in his heart and his mind then<\/a>.<\/p>\n<p>It\u2019s why Ervin sees the International Olympic Committee\u2019s broad prohibition against protests and demonstrations on the podium, codified as <a href=\"https:\/\/www.olympic.org\/-\/media\/document%20library\/olympicorg\/news\/2020\/01\/rule-50-guidelines-tokyo-2020.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Rule 50 in the Olympic Charter<\/a>, as so out of step with the reality of sports\u2019 place in the world.<\/p>\n<p>\u201cWhat is going to be in a person\u2019s heart? And are you going to be allowed to do it?,\u201d Ervin told <em>Swimming World<\/em> this week. \u201cI\u2019ve stood on the podium singing the Star-Spangled Banner as loud as I could. And I don\u2019t sing very well, so it was probably a little off-key, to the cringing of maybe some ears nearby. But I was proud, and that was in my heart.<\/p>\n<p>\u201cWho knows what\u2019s going to be in somebody\u2019s heart? I don\u2019t get to tell anybody what\u2019s in their heart in that moment, when they get to reflect on how they got there and the country they come from. For many athletes, an Olympic podium is the most visible platform they\u2019ll ever have. Thus, a movement is underway to get the IOC to reconsider its stance.<\/p>\n<p>Rule 50 is a gilded cage of a directive. Its preamble states that \u201cthe IOC Athletes\u2019 Commission and the IOC are fully supportive of freedom of expression,\u201d before setting the guideposts between which athletes are expressly barred from expressing themselves.<\/p>\n<blockquote><p><em>Rule 50 of the Olympic Charter provides a framework to protect the neutrality of sport and the Olympic Games. It states that, \u201cNo kind of demonstration or political, religious or racial propaganda is permitted in any Olympic sites, venues or other areas.\u201d<\/em><\/p><\/blockquote>\n<p>It restricts protests and demonstrations from the field of play, the Olympic Village, and during all official ceremonies (Opening, Closing, medal). The rule exists in a world governed by \u201ca fundamental principle that sport is neutral and must be separate from political, religious or any other type of interference,\u201d a world that differs sharply from reality. Among the actions that constitute impermissible protest are \u201cdisplaying any political messaging, including signs or armbands; gestures of a political nature, like a hand gesture of kneeling; refusal to follow the Ceremonies protocol.\u201d<\/p>\n<p>Rule 50 does allow (or rather, fails to prevent) athletes to express themselves with the media, at team meetings and in digital or social media platforms.<\/p>\n<p>It\u2019s no wonder that the restrictions are under particular assault in the current moment. For Ervin, a representative on behalf of USA Swimming to the U.S. Olympic and Paralympic Athletes&#8217; Advisory Council, the constraint on personal freedom is a big issue.<\/p>\n<p>\u201cFor me, it boils down to two things,\u201d he said. \u201cHow are you attempting to control someone\u2019s body? The podium is a place for you to commune with your country. Is that political or not? I don\u2019t know.\u201d<\/p>\n<p>Recent protests have hit Anthony Ervin hard. The <a href=\"https:\/\/www.swimmingworldmagazine.com\/news\/anthony-ervin-once-again-claims-olympic-50-free-gold-sixteen-years-after-original\/\" target=\"_blank\" rel=\"noopener noreferrer\">first black American swimmer<\/a> to win an individual gold medal, he turned 39 on May 26, a day after <strong>George Floyd<\/strong> was killed by Minneapolis police, what Ervin unflinchingly calls \u201ca lynching\u201d. Ervin watched the video, of <strong>Derek Chauvin<\/strong> pressing his knee on Floyd\u2019s neck for 8 minutes, 46 seconds until and after his life ended, for the first time on his birthday.<\/p>\n<p>\u201cJust sadness. And coldness and numbness,\u201d Ervin said. \u201cAnd a powerlessness, that this had happened again. He relocated for quarantine to Canada, where his fianc\u00e9e and their young daughter live in Ontario. Without a pool, Ervin has stayed in shape by taking runs through his neighborhood.<\/p>\n<p>Seeing Arbery, a 25-year-old black man, <a href=\"https:\/\/www.nytimes.com\/article\/ahmaud-arbery-shooting-georgia.html\" target=\"_blank\" rel=\"noopener noreferrer\">targeted and shot by two white men<\/a> in Brunswick, Georgia, on Feb. 23 while jogging, was chilling.<\/p>\n<p>\u201cThis guy goes out for a jog and to just be accosted and murdered, for what?,\u201d Ervin said. \u201cWhat is it that you\u2019re trying to pony up as an excuse for murdering somebody? I go for a run every day. Is life really that much of a minefield? The decision is clear to me that it\u2019s racism that led to that.\u201d<\/p>\n<p>Athlete activism, like police brutality and racial injustice, isn\u2019t a new conversation, even if recent news has provided a recent surge. <strong>John Carlos<\/strong> and <strong>Tommie Smith<\/strong> endured fallout from their famous raised-fist protest on the podium of the men\u2019s 200-meter dash at the 1968 Olympic Games in Mexico City, which got them expelled from the Athletes Village and vilified in the media. <a href=\"https:\/\/www.amazon.com\/Silent-Gesture-Autobiography-Tommie-Sporting\/dp\/1592136400\" target=\"_blank\" rel=\"noopener noreferrer\">Both have written<\/a> about <a href=\"https:\/\/www.amazon.com\/John-Carlos-Story-Sports-Changed\/dp\/B0085S534W\" target=\"_blank\" rel=\"noopener noreferrer\">that experience<\/a> and become forerunners of the athlete activism that is now commonplace.<\/p>\n<p>\u201cIn trying to stand up for human rights, for the equality of all people, they were condemned and cast aside for decades, until through the arc of time and history \u2013 and I\u2019m sure a lot of people knew at the time they were right, absolutely \u2013 but it became consensus decades later that they had done the right thing,\u201d Ervin said. \u201cAnd yet, they were punished for a good part of their life for taking a stand in that way. Now, we\u2019re seeing something very similar.\u201d<\/p>\n<p>More recently, <strong>Colin Kaepernick\u2019s<\/strong> kneeling protest during the national anthem has led to new awareness. <strong>Megan Rapinoe<\/strong> of the U.S. women\u2019s national soccer team, who could be in Tokyo next summer, also <a href=\"https:\/\/www.theplayerstribune.com\/en-us\/articles\/megan-rapinoe-why-i-am-kneeling\" target=\"_blank\" rel=\"noopener noreferrer\">took a knee during the national anthem in 2016<\/a>. Ervin himself knelt <a href=\"https:\/\/www.swimmingworldmagazine.com\/news\/anthony-ervin-kneels-for-national-anthem-at-raia-rapida\/\" target=\"_blank\" rel=\"noopener noreferrer\">during the national anthem at a meet in 2017<\/a>. American fencer <strong>Race Imbolden<\/strong> and hammer-thrower <strong>Gwen Berry<\/strong> were each placed on one-year probation for medal-stand protests (<a href=\"https:\/\/www.nytimes.com\/2019\/08\/11\/sports\/race-imboden-fencer-kneels.html\" target=\"_blank\" rel=\"noopener noreferrer\">kneeling<\/a> and <a href=\"https:\/\/www.espn.com\/espnw\/life-style\/story\/_\/id\/27699003\/with-fist-raised-olympic-track-field-star-gwen-berry-determined-make-difference\" target=\"_blank\" rel=\"noopener noreferrer\">fist-raising<\/a>, respectively) at the 2019 Pan Am Games.<\/p>\n<p>The current moment has brought Rule 50 back into the sights. Global Athlete, an international coalition of athletes, <a href=\"https:\/\/www.swimmingworldmagazine.com\/news\/global-athlete-calls-on-ioc-to-immediately-abolish-olympic-ban-on-kneeling\/\" target=\"_blank\" rel=\"noopener noreferrer\">has urged the IOC to abolish Rule 50<\/a>. Group of Athletes in <a href=\"https:\/\/www.irishtimes.com\/sport\/other-sports\/irish-olympians-invited-to-take-a-stand-on-ioc-rule-50-1.4285369\" target=\"_blank\" rel=\"noopener noreferrer\">Ireland<\/a>, <a href=\"https:\/\/www.lillooetnews.net\/canada-s-sports-ethics-body-wants-ioc-to-amend-rule-50-for-sake-of-human-rights-1.24158320\" target=\"_blank\" rel=\"noopener noreferrer\">Canada<\/a>, <a href=\"https:\/\/www.insidethegames.biz\/articles\/1095534\/athletes-germany-rule-50-review\">Germany<\/a> and the <a href=\"https:\/\/www.wdrb.com\/sports\/us-olympic-leaders-eye-change-on-protests-amid-wary-athletes\/article_31b9e8a0-98f1-568d-8a5d-b15f3a0dae4a.html\" target=\"_blank\" rel=\"noopener noreferrer\">United States<\/a> have backed alternatives from repeal to overhaul.<\/p>\n<p>Anthony Ervin is hopeful that progress will be made while being sympathetic to the IOC\u2019s aim. The Olympic movement is founded on high ideals and has to mollify a lot of stakeholders, but the reality often falls short of those aspirations. He\u2019s seen how other nations have launched protests similar to America\u2019s, and the cultural interconnectedness of the world makes Rule 50 particularly against the tide.<\/p>\n<p>\u201cThe world is a little too interconnected to think that that\u2019s going to fly,\u201d Ervin said. \u201cSo they\u2019ve got to sort something out, because if their stance is, \u2018you can say and do whatever you want anywhere, just not there,\u2019 well, that\u2019s the one place where it\u2019s going to have the most impact.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Conversations about athletes&#8217; roles in protesting systemic racial inequality and police brutality have been reignited this week by the shooting of Jacob Blake in Kenosha, Wisc.
