﻿{"id":435964,"date":"2020-06-16T12:28:10","date_gmt":"2020-06-16T19:28:10","guid":{"rendered":"https:\/\/www.swimmingworldmagazine.com\/news\/?p=435964"},"modified":"2024-10-28T11:32:08","modified_gmt":"2024-10-28T18:32:08","slug":"german-athletes-welcome-bach-readiness-to-relax-rule-50-allow-peaceful-protest","status":"publish","type":"post","link":"https:\/\/www.swimmingworldmagazine.com\/news\/german-athletes-welcome-bach-readiness-to-relax-rule-50-allow-peaceful-protest\/","title":{"rendered":"German Athletes Welcome Bach Readiness To Relax Rule 50 &#038; Allow Peaceful Protest"},"content":{"rendered":"<p><span lang=\"EN-US\"><strong>Athleten\u00a0Deutschland<\/strong>, the German\u00a0athlete-representative\u00a0body,\u00a0has welcomed an\u00a0<strong>International Olympic Committee (IOC)<\/strong>\u00a0u-turn on its stance on <strong><a href=\"https:\/\/www.olympic.org\/-\/media\/document%20library\/olympicorg\/news\/2020\/01\/rule-50-guidelines-tokyo-2020.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Rule 50 <\/a><\/strong>of the Olympic Charter.<\/span><\/p>\n<p>Until recently, the<a href=\"https:\/\/www.swimmingworldmagazine.com\/news\/olympic-bosses-warn-athletes-that-they-face-a-ban-if-they-take-the-knee-in-peaceful-protest-over-injustice\/\" target=\"_blank\" rel=\"noopener noreferrer\"> IOC had been firmly entrenched in its anti-protest stance, issuing a warning to athletes of late <\/a>that those heading to the Tokyo 2020 Olympic Games, now in 2021 due to the COVID-19 pandemic, that they faced punishments if they engaged in acts of peaceful protest such as taking a knee.<\/p>\n<p>That sparked an immediate call from <a href=\"https:\/\/www.swimmingworldmagazine.com\/news\/global-athlete-calls-on-ioc-to-immediately-abolish-olympic-ban-on-kneeling\/\" target=\"_blank\" rel=\"noopener noreferrer\">Global Athlete<\/a> to think again, <a href=\"https:\/\/globalathlete.org\/our-word\/ioc-rule-50\" target=\"_blank\" rel=\"noopener noreferrer\">the group issuing this statement on Sunday<\/a>.<\/p>\n<p>The IOC\u2019s Athletes\u2019 Commission released further guidelines in January to clarify Rule 50, which bans all protests. Those left &#8220;no wiggle room for athletes to protest in any way without punishment&#8221;, said the Athletes&#8217; Commission.<\/p>\n<p>Change is on the wind, however, after IOC president <strong>Thomas Bach<\/strong>\u00a0declared last week that the federation would work with the Athletes\u2019 Commission to relax the protest rules in the face of widespread kickback from athletes noting their right to speak out and show solidarity for the <strong>Black Lives Matter<\/strong> movement in the wake of the brutal death of <strong>George Floyd<\/strong>.<\/p>\n<p>In its January guidelines, the IOC Athletes\u2019 Commission asked:\u00a0What does the Olympic Charter say on this matter? [of protests]. It then answers as follows:<\/p>\n<blockquote><p><em>The Olympic Charter is the codification of the fundamental principles of Olympism, rules and bye-laws adopted by the IOC. It governs the organisation, action and operation of the Olympic Movement, and sets forth the conditions for the celebration of the Olympic Games.\u00a0Rule 50 of the Olympic Charter provides a framework to protect the neutrality of sport and the Olympic Games. It states that:<\/em><\/p>\n<p><em> \u201cNo kind of demonstration or political, religious or racial propaganda is permitted in any Olympic sites, venues or other areas.\u201d<\/em><\/p><\/blockquote>\n<p>Now, athletes are suggesting far and wide that if they wish to take a knee or show &#8211; through peaceful acts of protest to raise awareness and contribute to change &#8211; solidarity with those suffering discrimination, they should be allowed to do so without threat of penalty.<\/p>\n<p>The issue is relevant to the punishments handed down by FINA, the international federation, to <a href=\"https:\/\/www.swimmingworldmagazine.com\/news\/mack-horton-must-lose-his-medal-was-call-of-fina-bosses-after-podium-protest-against-sun-yang\/\" target=\"_blank\" rel=\"noopener noreferrer\">Australia&#8217;s Matt Horton<\/a>, Britain&#8217;s<a href=\"https:\/\/www.swimmingworldmagazine.com\/news\/duncan-scott-fully-respects-and-supports-cas-decision-their-commitment-to-clean-sport\/\" target=\"_blank\" rel=\"noopener noreferrer\"> Duncan Scott<\/a> and the man who screamed &#8216;you loser&#8217; in the Scotsman&#8217;s face, China&#8217;s <a href=\"https:\/\/www.swimmingworldmagazine.com\/news\/sun-yang-cas-report-in-full-athlete-actions-wholly-inappropriate-idtm-testing-exonerated\/\" target=\"_blank\" rel=\"noopener noreferrer\">Sun Yang<\/a>, now suspended for eight years, pending a last-ditch appeal on procedures, rights and technicalities to the Swiss Federal Tribunal.<\/p>\n<p>Bach has indicated his willingness to listen. Today, athletes in his own country, issued the following:<\/p>\n<h3><strong><span lang=\"EN-US\">Statement on the\u00a0Revision of Rule 50 of the Olympic Charter<\/span><\/strong><span lang=\"EN-US\">\u00a0from <strong>Athleten\u00a0Deutschland<\/strong><\/span><u><\/u><u><\/u><\/h3>\n<p><em><span lang=\"EN-US\"><strong>Athleten\u00a0Deutschland<\/strong> welcomes Thomas Bach\u2019s initiative to review Rule 50 of the Olympic Charter\u00a0including the\u00a0ban on political protests. The restriction of freedom of opinion in sport can only be tolerated if athletes and federations jointly determine possible limits and thus legitimize them through a jointly negotiated consensus.\u00a0\u00a0<\/span><u><\/u><u><\/u><\/em><\/p>\n<p><em><span lang=\"EN-US\">To allow for a meaningful\u00a0and sustainable consultation process with athletes, we expect the IOC Athletes\u2019 Commission and the IOC leadership to respect and fully implement the following principles:\u00a0\u00a0<\/span><u><\/u><u><\/u><\/em><\/p>\n<p><em><strong><span lang=\"EN-US\">1.\u00a0Genuine inclusion\u00a0<\/span><\/strong><span lang=\"EN-US\"><br \/>\nThe consultation process and any changes to Rule 50 must be based on feedback from the athletes\u2019 representatives. Independent athlete\u00a0groups\u00a0representing Olympic athletes must be included\u00a0with equal consideration.\u00a0The terms of the consultation process must be jointly defined by all participants prior to its start.\u00a0<\/span><u><\/u><u><\/u><\/em><\/p>\n<p><em><strong><span lang=\"EN-US\">2.\u00a0Transparency\u00a0<\/span><\/strong><span lang=\"EN-US\"><br \/>\nFeedback must be made publicly available and visible. If\u00a0certain pieces of\u00a0feedback\u00a0are\u00a0rejected or not considered, the IOC Athletes\u2019 Commission must\u00a0provide a justification for the rejection.\u00a0\u00a0<\/span><u><\/u><u><\/u><\/em><\/p>\n<p><em><strong><span lang=\"EN-US\">3.\u00a0Accountability\u00a0<\/span><\/strong><span lang=\"EN-US\"><br \/>\nThe IOC Executive Committee must commit itself to implementing the results of the consultation. It must report transparently on\u00a0how these\u00a0results\u00a0are reflected in its decision-making\u00a0process for the review of Rule 50.\u00a0\u00a0\u00a0<\/span><u><\/u><u><\/u><\/em><\/p>\n<p><em><span lang=\"EN-US\"><strong>Johannes\u00a0Herber<\/strong>, CEO of\u00a0Athleten\u00a0Deutschland, adds: <\/span><\/em><\/p>\n<blockquote><p><em><span lang=\"EN-US\">\u201cIt is perilous\u00a0to limit\u00a0any\u00a0possible changes to Rule 50 in advance to the scope of the Olympic Charter.\u00a0The Charter\u00a0does not\u00a0include\u00a0a commitment to fundamental human rights. While the\u00a0IOC\u2019s\u00a0principle of non-discrimination is\u00a0crucially\u00a0important, it does not cover many other rights\u00a0worthy\u00a0of protection.\u201d\u00a0\u00a0\u00a0<\/span><u><\/u><u><\/u><\/em><\/p><\/blockquote>\n<p><em><span lang=\"EN-US\">In light of this\u00a0discussion, we refer to the\u00a0<\/span><a href=\"https:\/\/athleten-deutschland.org\/wp-content\/uploads\/2020\/06\/20191016_8th-Fundamental-Principle-of-Olympism-Letter-to-Dr.-Thomas-Bach.pdf\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/athleten-deutschland.org\/wp-content\/uploads\/2020\/06\/20191016_8th-Fundamental-Principle-of-Olympism-Letter-to-Dr.-Thomas-Bach.pdf&amp;source=gmail&amp;ust=1592395343923000&amp;usg=AFQjCNEpAMhEF_JMiWhmFJHHip5AbcOqpw\"><span lang=\"EN-US\">call<\/span><\/a><span lang=\"EN-US\">\u00a0to include\u00a0an eighth fundamental principle of Olympism in the Olympic Charter. This\u00a0would see the IOC commit to respecting\u00a0all internationally recognized human rights. The call made\u00a0by\u00a0Athleten\u00a0Deutschland\u00a0<wbr \/>together with athlete\u00a0groups\u00a0from other countries already in October 2019.\u00a0\u00a0<\/span><u><\/u><u><\/u><\/em><\/p>\n<p><em><span lang=\"EN-US\"><strong>Maximilian Klein<\/strong>, Representative for International Sports Policy for\u00a0Athleten\u00a0Deutschland: <\/span><\/em><\/p>\n<blockquote><p><span lang=\"EN-US\"><em>\u201cPrevious consultation and participation processes have not sufficiently met basic democratic standards. The involvement of athletes in the postponement of the Olympic Games was\u00a0unsatisfactory; the announced consultation procedure on Rule 40 has not yet taken place. We are of course happy to be convinced of the opposite and expect the process to be initiated swiftly by the end of June.\u201d<\/em>\u00a0<\/span><\/p><\/blockquote>\n<p>The statement follows moves by other organisations, including close IOC affiliates such as the United States Olympic and Paralympic Committee, \u00a0in support of the right of athletes to protest.<\/p>\n<p>USOPC CEO <strong>Sarah Hirshland<\/strong> announced that the organisation would be forming an athletes\u2019 working group to \u201cchallenge the rules and systems in our own organization that create barriers to progress.\u201d<\/p>\n<p>Some athletes see USOPC as a barrier to progress, even now. According to\u00a0the Associated Press, Hirshland decided to form the athletes\u2019 working group without consulting the USOPC\u2019s Athletes\u2019 Advisory Council (AAC).<\/p>\n<p>The AAC\u2019s first vice chair, <strong>Cody Mattern<\/strong>, believed the lack of consultation was a blip and that focus needed to be on where it was most needed. He told AP:<\/p>\n<blockquote><p>\u201cWhile there was a breakdown in communication last week with the USOPC, we must all focus on the larger task at hand: addressing life-threatening racial injustice.&#8221;<\/p><\/blockquote>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Athleten\u00a0Deutschland, the German\u00a0athlete-representative\u00a0body,\u00a0has welcomed an\u00a0International Olympic Committee (IOC)\u00a0u-turn on its stance on Rule 50 of the Olympic Charter.
