{"id":398167,"date":"2019-10-14T12:51:12","date_gmt":"2019-10-14T19:51:12","guid":{"rendered":"https:\/\/www.swimmingworldmagazine.com\/news\/?p=398167"},"modified":"2019-10-15T09:18:18","modified_gmt":"2019-10-15T16:18:18","slug":"sun-yang-cas-hearing-confirmed-for-november-15-by-court-of-arbitration","status":"publish","type":"post","link":"https:\/\/www.swimmingworldmagazine.com\/news\/sun-yang-cas-hearing-confirmed-for-november-15-by-court-of-arbitration\/","title":{"rendered":"Sun Yang CAS Hearing Confirmed for November 15 By Court Of Arbitration"},"content":{"rendered":"<div class=\"page\" title=\"Page 1\">\n<div class=\"layoutArea\">\n<p><strong><em>Sun Yang CAS Hearing Confirmed for November 15<\/em><\/strong><\/p>\n<p>The <a href=\"https:\/\/www.swimmingworldmagazine.com\/news\/sun-yangs-court-of-arbitration-hearing-to-be-heard-november-15-says-chinese-lawyer\/\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>Court of Arbitration for Sport (CAS)<\/strong> has confirmed the news we broke yesterday: November 15 marks the date when thew court will hear in public a\u00a0<strong>World Anti-Doping Agency (WADA)<\/strong>\u00a0challenge to a decision of the <strong>FINA Doping Panel<\/strong> to allow <strong>Sun Yang<\/strong><\/a> to escape penalty despite a series of warnings and cautions issued to the swimmers after an acrimonious four-hour argument in the night in September 2018 with testing agents from the IDTM agency hired by FINA.<\/p>\n<p>The hearing will take place at the Conference Centre of the Fairmont Le Montreux Palace in Montreux\/Switzerland.<\/p>\n<p>The swimmer, said the Doping Panel in its January 2019 report into the case, \u00a0had &#8220;risked his entire career&#8221; by arguing against a test visit proceeding as usual on grounds that the FINA panel lawyers did not agree with him on. Testers also made mistakes.<\/p>\n<p>CAS will now decide:<\/p>\n<div class=\"column\">\n<h2 style=\"text-align: center;\">THE HEARING IN THE CAS ARBITRATION PROCEDURE BETWEEN WADA, SUN YANG AND FINA<\/h2>\n<h2 style=\"text-align: center;\">TO BE HELD IN PUBLIC\u00a0ON 15 NOVEMBER 2019<\/h2>\n<p><em>Lausanne, 14 October 2019 &#8211; <a href=\"https:\/\/www.tas-cas.org\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>The Court of Arbitration for Sport (CAS)<\/strong><\/a> will hear the appeal filed by the <a href=\"https:\/\/www.wada-ama.org\" target=\"_blank\" rel=\"noopener noreferrer\">World Anti-Doping Agency (WADA)<\/a> against the Chinese swimmer <strong>Sun Yang<\/strong> and the <strong>F\u00e9d\u00e9ration Internationale de Natation (FINA)<\/strong> on Friday 15 November 2019. The location will be the Conference Centre of the Fairmont Le Montreux Palace in Montreux\/Switzerland. The appeal was brought to CAS in relation to a decision issued by the FINA Doping Panel dated 3 January 2019 whereby Sun Yang was found not to have committed an anti-doping rule violation following an out-of-competition doping control.<\/em><\/p>\n<p><em>At the parties\u2019 request, the hearing will be open to the public. Print media will be allowed in priority. Photo and video media will be invited to leave the hearing room after the opening. With the agreement of all parties, it is intended to live stream all or parts of the hearing on the CAS website. Further information regarding registration will follow in due course. In any event, registration will be required and only the persons correctly registered via the official procedure will be admitted in the hearing room.<\/em><\/p>\n<p><em>This will be the second time in the history of CAS that a hearing is held in public. The first public hearing, which took place in 1999, was also related to the sport of swimming, in the matter <strong>Michelle Smith De Bruin v.
