{"id":383385,"date":"2019-07-25T08:09:54","date_gmt":"2019-07-25T15:09:54","guid":{"rendered":"https:\/\/www.swimmingworldmagazine.com\/news\/?p=383385"},"modified":"2019-07-25T08:09:54","modified_gmt":"2019-07-25T15:09:54","slug":"mark-schubert-suit-dropped-by-ariana-kukors-smith-other-suits-remain","status":"publish","type":"post","link":"https:\/\/www.swimmingworldmagazine.com\/news\/mark-schubert-suit-dropped-by-ariana-kukors-smith-other-suits-remain\/","title":{"rendered":"Mark Schubert Suit Dropped by Ariana Kukors Smith, Other Suits Remain"},"content":{"rendered":"<p>A lawsuit against former national team coach <strong>Mark Schubert<\/strong> has been dropped, according to Superior Court of California in Orange County documents.<\/p>\n<p><strong>Ariana Kukors Smith<\/strong> filed a suit on May 21, 2018 against Schubert, USA Swimming, King Aquatic Club, the King Aquatic Club Boosters, <strong>Sean Hutchison<\/strong> and Pacific Northwest Swimming claiming negligence in wake of alleged sexual assault by coach Hutchison.<\/p>\n<p>The <a href=\"https:\/\/www.swimmingworldmagazine.com\/news\/ariana-kukors-files-civil-suit-against-sean-hutchison-usa-swimming-mark-schubert\/\" target=\"_blank\" rel=\"noopener noreferrer\">suit<\/a> against Schubert has been dropped, while the suits against the other defendants have not.<\/p>\n<p>\u201cI am gratified to have the suit against me dismissed,\u201d Schubert told <em>Swimming World<\/em>. \u201cHowever, it was a tremendous waste of time, effort and money over a groundless accusation.\u201d<\/p>\n<p>The settlement agreement states:<\/p>\n<blockquote><p><strong> \u201cThe Parties desire and intend by this Release to settle, finally and completely, all of the disputes, differences, disagreements, claims, cross-claims, demands, liabilities, damages, liens, judgments, disputes, and causes of action of every kind and nature whatsoever, at law or in equity, known or unknown, suspected, or unsuspected, arising from or in any way related to the claims and Complaint.&#8221;<\/strong><\/p><\/blockquote>\n<p>It was alleged in the suit that <a href=\"https:\/\/ishof.org\/mark-schubert.html\" target=\"_blank\" rel=\"noopener noreferrer\">Schubert<\/a> did not do enough after finding out about a possible inappropriate relationship between Kukors and Hutchison. Schubert <a href=\"https:\/\/www.swimmingworldmagazine.com\/news\/mark-schubert-responds-to-legal-challenge-from-ariana-kukors-smith\/\" target=\"_blank\" rel=\"noopener noreferrer\">defended that<\/a> from the beginning, telling <em>Swimming World<\/em> <a href=\"https:\/\/www.swimmingworldmagazine.com\/news\/former-usa-coach-mark-schubert-says-hutchison-kukors-rumors-were-reported\/\" target=\"_blank\" rel=\"noopener noreferrer\">he looked into the rumors<\/a> immediately and passed it along to the CEO of the Fullerton Area Swim Team (FAST), <strong>Bill Jewell<\/strong>.<\/p>\n<p>Despite reporting the rumors, Schubert said he would have handled the situation differently if he could do it over again.<\/p>\n<p>\u201cWe are all a lot more educated in this subject,\u201d Mark Schubert said. \u201cI would have alerted the police to the situation with the rumors. Back then, you felt like you weren\u2019t sure what to say. it is obvious from (Ariana\u2019s) comments that she wishes someone would have said something even if she didn\u2019t say something.\u201d<\/p>\n<p>Kukors detailed her relationship with Hutchison, which she says included\u00a0<a href=\"https:\/\/www.swimmingworldmagazine.com\/news\/295036-2\/\">sexual abuse and \u201cgrooming<\/a>\u201d her as a teenager.<\/p>\n<p><a href=\"https:\/\/www.swimmingworldmagazine.com\/news\/sean-hutchison-denies-abusing-ariana-kukors-officially-leaves-king-aquatic-club\/\">Hutchison has denied\u00a0allegations of abuse<\/a>, insisting that their relationship was consensual and happened after Kukors was an adult.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A lawsuit against former national team coach Mark Schubert has been dropped, according to Superior Court of California in Orange County documents.
