{"id":344892,"date":"2019-01-02T09:48:50","date_gmt":"2019-01-02T16:48:50","guid":{"rendered":"https:\/\/www.swimmingworldmagazine.com\/news\/?p=344892"},"modified":"2019-01-02T09:49:07","modified_gmt":"2019-01-02T16:49:07","slug":"moscow-laboratory-fails-to-hand-over-data-to-world-anti-doping-agency","status":"publish","type":"post","link":"https:\/\/www.swimmingworldmagazine.com\/news\/moscow-laboratory-fails-to-hand-over-data-to-world-anti-doping-agency\/","title":{"rendered":"Moscow Laboratory Fails to Hand Over Data to World Anti-Doping Agency"},"content":{"rendered":"<p>The World Anti-Doping Agency (WADA) refers to its\u00a0<a href=\"https:\/\/www.swimmingworldmagazine.com\/news\/world-anti-doping-agency-releases-update-on-mission-to-extract-data-from-moscow-laboratory\/\">media release of 21 December 2018<\/a>, which\u00a0announced that a five-person WADA expert team, led by independent expert Dr. <strong>Jos\u00e9 Antonio (Toni) Pascual<\/strong>, had returned from its mission to Russia without having accessed the Laboratory Information Management System (LIMS) and the underlying data from the former Moscow Laboratory.<br>\u00a0<br>Today (1 January 2019), WADA confirms that since the Agency issued that release, no further missions to Russia have been carried out. Accordingly, the 31 December 2018 deadline \u2013 by which time the Russian authorities had to provide access to the data \u2013 has elapsed without the data having been retrieved. The deadline was one of two conditions stipulated in WADA\u2019s 20 September\u00a0<a href=\"https:\/\/www.swimmingworldmagazine.com\/news\/russian-anti-doping-agency-reinstated-by-wada-subject-to-strict-conditions\/?preview_id=329922&amp;preview_nonce=067fe9d932&amp;preview=true&amp;_thumbnail_id=277270\">Executive Committee (ExCo) decision<\/a>\u00a0regarding the Russian Anti-Doping Agency\u2019s (RUSADA\u2019s) compliance with the World Anti-Doping Code (Code).<\/p><blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>WADA President Sir <strong>Craig Reedie<\/strong> said: \u201cI am bitterly disappointed that data extraction from the former Moscow Laboratory has not been completed by the date agreed by WADA\u2019s ExCo in September 2018. Since then, WADA has been working diligently with the Russian authorities to meet the deadline, which was clearly in the best interest of clean sport. The process agreed by WADA\u2019s ExCo in September will now be initiated.\u201d<br>\u00a0<br>In keeping with the process that was outlined by the ExCo in September 2018:<\/p><\/blockquote><ul class=\"wp-block-list\"><li>This week, Dr. Pascual\u2019s formal mission report, along with all other relevant information and documentation, will be sent to the independent Compliance Review Committee (CRC) for consideration;<\/li><li>On 14-15 January 2019, the CRC will meet and review all available elements. The CRC will provide a recommendation to the WADA Executive Committee based on the applicable rules, namely the\u00a0International Standard for Code Compliance by Signatories (ISCCS), which entered into force on 1 April 2018, and the Code; and<\/li><li>As soon as practicable thereafter, the CRC\u2019s recommendation will be considered by the ExCo.\u00a0<\/li><\/ul><p>Under the ISCCS, if the CRC recommends non-compliance, and the ExCo agrees with it, RUSADA will have the right to challenge that assertion to the Court of Arbitration for Sport (CAS), who will hear the case and take the final decision.<br>\u00a0<br>WADA has now written to Russia\u2019s Minister of Sport, <strong>Pavel Kolobkov<\/strong>, and the Director General of RUSADA, <strong>Yuri Ganus<\/strong>, to officially notify them of the situation and to remind them of the next steps in the process.<br>\u00a0<br>Given the importance for clean sport of access to, and subsequent authentication and analysis of, the data from the former Moscow Laboratory in order to build strong cases against cheats and exonerate other athletes, WADA experts continue to be ready to proceed with extraction of the data should the issue reported upon on\u00a021 December\u00a0be resolved by the Russian authorities.
