FORMER Tennessee men&#39;s swimming head coach John Trembley has elected to forgo the appeals process for his termination that occurred on Jan. 3 according to the <i>News Sentinel<\/i>.<\/p>\n<p>&quot;At this time my client has no intentions of appealing his dismissal,&quot; Trembley&#39;s attorney, former UT swimmer Don Bosch, told the <i>News Sentinel<\/i> on Tuesday.<\/p>\n<p>Trembley, as <a href=http:\/\/www.swimmingworldmagazine.com\/lane9\/news\/College\/29162.asp target=_blank>previously reported<\/a>, was dismissed from Tennessee earlier this month for &quot;gross misconduct.&quot;  This gross misconduct, which has yet to be detailed in public, led to the Knoxville Police Department launching a criminal investigation of Trembley&#39;s actions that led to his termination. <\/p>\n<p>&quot;The finding of gross misconduct led us to turn this case over to the proper law enforcement authorities,&quot; Margie Nichols, UT&#39;s vice chancellor for communications, said in a news release sent to the KNS. &quot;Since this is an ongoing investigation, we are unable to comment further.&quot;<\/p>\n<p>Trembley&#39;s contracted defined gross misconduct as &quot;theft or dishonesty; gross insubordination; willful destruction of University property; falsification of records; acts of moral turpitude; reporting for duty under the influence of intoxicants: illegal use, manufacture, possession, distribution, or dispensing of controlled substances or alcohol; disorderly conduct; provoking a fight; and other similar acts involving intolerable behavior by the employee.&quot;<\/p>\n<p>While no news has come out regarding the specific action that led to Trembley&#39;s dismissal, Knoxville PD assigned investigator Richard Giammarino to the case.
