Anthony Marcantonio<\/strong>,\u00a0a\u00a019 year old former member of the University of Virginia Swimming & Diving team, has filed a 10 count lawsuit against his five former teammates. According to an article in the Charlottesville\u00a0Daily Progress,<\/em>\u00a0the suit includes allegations related to hazing\u00a0that occurred in the fall of 2014.<\/p>\n

Kyle Dudzinski<\/strong>, Luke Papendick<\/strong>, Charles Rommel<\/strong>, David Ingraham<\/strong> and Jacob Pearce<\/strong> are the accused and were all upperclassmen on the UVA swim team at the time of the alleged incident. You may remember the five accused men as\u00a0the same who were suspended from competition in October of 2014<\/a>. At that time they\u00a0were suspended\u00a0\u201cfor violations of University of Virginia policy and athletics department rules.\u201d Ingraham was also part of a group of eight athletes who were suspended in October 2013 in another very public team suspension.<\/p>\n

According to The Daily Progress,\u00a0<\/em>Marcantonio’s case alleges that the actions of these five men were \u201coutrageous and intolerable and [offending] generally accepted standards of decency and morality.\u201d Details of the suit describe the alleged abuse that\u00a0Marcantonio was subjected to by the five defendants, which began on\u00a0August 27\/28.<\/p>\n

The Daily Progress<\/em> reports that on this day\/night, the suit claims that Marcantonio and\u00a0other first-year members of the team arrived at a Wertland Street house known\u00a0as the \u201cSwim House\u201d and were subjected to blindfolding, false imprisonment, forced to drink liquids (beers, liquor, milk and prune juice, verbal abuse), forced sexual contact, and a several other\u00a0intimidation tactics including the threat of forced sodomy.<\/p>\n

Among the alleged abuse the suit details occured to\u00a0Marcantonio and fellow first-year team members includes being\u00a0“told\u00a0to chew live goldfish and grab one another\u2019s genitalia,” as well as being\u00a0“asked sexually explicit questions about themselves and members of the UVA women\u2019s swimming team.”<\/p>\n

According to\u00a0the plaintiff’s statements, this abuse continued\u00a0in the ensuing week after August 27\/28 in the form of e-mails from a joint account (“Mr. Mean”) that was created by the five defendants. E-mails from this account “compelled\u00a0the first-year swimmers to complete a ‘scavenger hunt’ that required them\u00a0to steal items from a retail store, the university and another teammate.”<\/p>\n

According to the lawsuit, Head Men’s\u00a0Coach Augie Busch <\/strong>was informed of the hazing allegations on September 6 by “a source outside the UVA community” and followed up with the alleged victims who relayed their experience.\u00a0UVA Dean of Students Allen Groves<\/strong>\u00a0was informed of the hazing allegations by the victims only a few days later on September 9.<\/p>\n

According to the suit these actions were met with additional threats from the five defendants. Marcantonio also alleges that Busch suggested “he\u00a0protect himself by only swimming when other members of the team weren\u2019t present,” and later on September 15 told Marcantonio that his\u00a0\u201cphysical safety could not be guaranteed.\u201d<\/p>\n<\/div>\n

Marcantonio\u00a0claims that his UVA swimming career was “destroyed” by the five defendants and that their actions caused him to void his contract with UVA. In addition to the counts alleged in the suit, Marcantonio will also be seeking punitive damages from the defendants. Marcantonio has transferred and now swims\u00a0for Northwestern University.<\/p>\n

Comments from UVA, Head Coach Augie\u00a0Busch, or a spokesman for UVA regarding Marcantonio’s allegations with be reported as soon as available.<\/p>\n
