Brock Turner’s Conviction Upheld By California Appeals Court

Brock Turner, the former Stanford University swimmer, who was sentenced to six months in jail in 2016 for sexually assaulting an unconscious women, had his conviction upheld by a California appeals court on Thursday.

His lawyers had appealed based on the fact that there was insufficient evidence that Turner had sought only “outercourse,” multiple news outlets reported.

But that did not sway the panel of judge. “We are not persuaded,” wrote Associate Justice Franklin D. Elia. “While it is true that defendant did not expose himself, he was interrupted.” Justice Elia wrote that jurors “reasonably could have inferred from the evidence” that if two graduate students had not stopped Mr. Turner when they saw him on top of the unresponsive woman, “he would have exposed himself and raped” her, according to the New York Times.

Turner was also charged with sexual assault of an intoxicated person and sexual assault with intent to commit rape. The felonies stemmed from his assault of a 22-year-old woman after she had blacked out from drinking at a campus party in January 2015, when he was 19.

The case drew national attention when Turner received his sentence, deemed a slap on the wrist for a crime of this sort.

It’s really time for the media to stop identifying this rapist as “a former Stanford swimmer” (I knew that exact phrase would be there before even reading) and simply as “convicted rapist.”

The swimming community clearly supports the court’s decision and that shows where the swim world’s values are.?

The reason it is news is because he was a very good swimmer and he got convicted of the strongest crime of rape for dry humping. He was convicted and has to register the same as a person that physically rips apart a woman or child due to rape and he and the victim were fully clothed. This is the reason his lawyers tried to get the conviction changed.

Amd no, Imam not defending him…i just think to put anyone cinvicted of dry humping while drunk in the same category as a brutal rapist is not balanced and looks unjust. Wouldnt be surprised if this goes to the Supreme Court as the punishment does not fit the crime.

He is a nasty man who deserves to be punished. He should get more jail time for his actions. But no where in the court filings or conviction was he found to have drugged her.
Situational awareness is something all people should know. The buddy system is also important and that all failed here.
I am just saying that to put him in the same category as a serial rapist, child molestor will drive this to a higher court.

I disagree. The court needs to send a clear message to the public and especially anyone considering this type of crime so that the premeditating predators will know that it’s not something that they will only receive a slap on the wrist for. She was doped you can bet on it. How else does someone get literally dragged away? Be real. You really are not putting yourself in her place. The smug people are those who have never been victimized.

The most important understanding here is that one wait till all the facts of truth are in to make a solid rock conclusion of truth. Here, There are MANY issues overlooked in Brock Turner’s acting role example.. The point here is as The Four Lettermen sang, “.. in a restless world like this is love is ended before it’s begun…”, there are more things to learning education is DEFINED as a progressive discovery of our own ignorance. Considering right and wrong, William Shakespeare said we are just actors on a stage! Of this, are you flying “The Lawful Flag of Peace?[Still lawful by President John Adams!]”
