Court Rejects Title IX Suit

WASHINGTON, D.C., Dec. 12. IN disheartening news for swimming and other Olympic sports, a federal court dismissed a lawsuit Wednesday that contends the U.S. Department of Education discriminated against male athletes in enforcing Title IX, which provides for equal opportunities for women.

The decision did not address the substance of the complaint brought by the National Wrestling Coaches Association (NWCA), but rather was based on a procedural issue: That the NWCA did not show that its complaint — a reduction in men's sports — would be fixed even if they won their case.

As a result, the court ruled that the NWCA and other athletic groups failed to show they were entitled to bring the suit over Title IX.

The NWCA plans to appeal.

"The fight is far from over," said Mike Moyer, Executive Director of the wrestling association.
"Every day that goes by and the quota system stays in place, men's teams are going to continue to be eliminated in wholesale numbers."'
