Tara Kirk, USA Swimming Settle Arbitration

BREMERTON, Washington, May 14. ACCORDING to The Seattle Times, Tara Kirk and USA Swimming have settled an arbitration regarding Kirk's claim that she was wrongfully denied a spot on the 2008 U.S. Olympic Roster after Jessica Hardy withdrew from the team due to testing positive for clenbuterol.

According to The Seattle Times, "USA Swimming settled the case as a followup arbitration loomed next week. Terms of the settlement were not announced, by mutual agreement. The parties issued a joint statement saying the matter had been ‘resolved to the satisfaction of all parties.'"

The timing of the settlement is interesting as Hardy just had her suspension reduced to one year after arbitration decided that her supplements were contaminated.

The final major lawsuit stemming from 2008 in the realm of USA Swimming is the one featuring TYR, Speedo and Mark Schubert as well as the national governing body. That litigation could take until 2010 to be resolved as TYR has claimed that Speedo has an unfair advantage within USA Swimming.
